Western Australian Aboriginal corporations to be wound up

The Registrar of Aboriginal and Torres Strait Islander Corporations, Anthony Beven, has obtained orders from the Supreme Court in Brisbane winding up two Aboriginal corporations: Ngarla Mia Mia Karlak Aboriginal Corporation and Nyunbuk Moorit Booja Aboriginal Corporation.

Mr Brian McMaster and Mr Jack James from KordaMentha in Perth were appointed liquidators by the Supreme Court.

The corporations’ activities centred around the Gibbingunya Farm situated at Quindanning in Western Australia.

On 7 March 2007 accountants KordaMentha conducted an examination of the corporations under section 60 of the Aboriginal Councils and Associations Act 1976, and identified a number of breaches of the Act and rules of the corporations.

These breaches included inadequate members’ lists, no records to confirm the holding of annual general meetings or committee meetings for several years, and the absence of accounts and records.

In his decision Justice Mackenzie found that ‘both corporations exhibited a continuing failure to financially manage the corporations in the manner required by law’.
